Changes to your Terms and Conditions

Curaçao legislative update

EM Group takes an active role in updating you with the latest regulatory changes applicable to your online gambling licenses. In respect thereof, in recent events with the local court, it has become necessary to update all Terms and Conditions (T&Cs) to maintain compliancy under Curaçao law.

T&C PROHIBITIONS AND PROVISIONS CHANGES

The following is a list of all the major T&C changes:

  1. Prohibition and explanation of multiple accounts including groups and households;
  2. Provision + rationale on maximum winning amount per day;
  3. Provision that all information submitted by the Player should be materially complete and correct + consequence term;
  4. Provision on national regulatory limitations;
  5. Provision on the applicable IP address rules (in connection with prohibition of multiple accounts);
  6. Provision on collusion;
  7. Provision on bonus rules;
  8. Provision containing self-exclusion rules, cooling-off periods and de-registration;
  9. Provision on a minimal wagering activity before withdrawals can be made;
  10. Various provisions on the registration of Players.

EM Group can make these changes for a price of EUR1,000.00. Any additional review will be charged on time spent basis (EUR200/hr). Should you agree with the quotation, please kindly provide us with a copy of your latest T&Cs so that we can amend and send you a final draft for approval.

PLAYER ACCOUNT REGISTRATION

Next to having good and complete T&C in place, it is equally important to provide the T&C to the player in the correct manner. We therefore strongly advise you to implement a pop up/check the box upon registration, containing the following information:

  • I am 18 years or older
  • I am playing for myself and with my own money
  • This is my first registration @....com
  • I have not self-excluded from any gambling website in the past 12 months
  • I have read and accept the terms and conditions
  • I declare that all information provided by me to …com is correct and can be verified and I understand that providing any form of incorrect information will void all winnings of my plays on …com
  • I am aware and acknowledge that ….com sets certain limitations to the maximum prizes that can be won per [day/week/month and/or can be withdrawn per day/week/month]

The player should have to actively answer the questions with yes/no before registration can be completed. Upon completion of the registration, a confirmation email for registration needs to be sent to the player with a numbered and date stamped version of the T&C, attached to it; the player needs to confirm receipt of the email and the T&C (preferably supported by some kind of unique identification process, such as confirming a unique code); no deposit can be made until this confirmation of receipt has been sent by the player;

Please note that every time that the T&C are updated, the above mentioned process should take place for all existing players as well, in order to ensure that the new T&C are applicable to the contractual relationship between the operator and the player.

Notwithstanding the aforementioned, it is important to also have a downloadable version of the current T&C on the URL. Please ensure that all versions of the T&C are numbered and date stamped. Examples of this can be “version 1.1, date (month, day, year)”, whereby new versions get a higher numbering.
