As you might be aware, since April 1st 2021, the Netherlands Gaming Authority
(Kansspelautoriteit/KSA) has opened the local online gambling market by starting the application
process for a Dutch online gambling license. This can be a great opportunity for you, but of course there are clear regulatory lines that must be adhered to.
There is one key challenge when setting up your iGaming business in the Netherlands: meeting
the obligation to legally separate player funds from the operator’s own risk baring capital. The most
viable method to adhere to the KSA’s requirements of separating player funds is setting up a
foundation. However, incorporating and maybe even more important, managing such a foundation
in the Dutch legal landscape comes with its own difficulties. These foundations must, for instance,
have independent directors and have to be regulatory and AML compliant amongst many other
challenges.
