Starting January 2025, Brazil's Federal legislation will introduce new regulations for the gaming sector. As a step towards to this new federal regulation, Normative Ordinance nr. 1,475 was issued in Brazil on September 16, 2024, which pertains to prohibitions of certain gaming services as of October 1, 2024.
Depending on the nature of the services that you offer in Brazil, this Normative Ordinance may have an impact on your services. Effective October 1st, the operation of fixed-odds lottery betting nationwide in Brazil by any operator is prohibited, unless the operator has received authorization from the Brazilian Ministry of Finance’s Prizes and Betting Secretariat, or is currently being accredited by a State lottery. Consequently, operators providing fixed-odds lottery betting will no longer be able to operate with a foreign license under Brazilian law.
Currently 121 parties in total have applied for such Federal license. The full list of parties that have submitted a license application can be found at https://sigap.fazenda.gov.br/consulta-publica/lista-solicitacoes.
However, operators holding a Curaçao gaming license and offering only online casino games in Brazil will not face this prohibition as of October 1, 2024. You may continue your operations in Brazil until the new legislation takes effect or further ordinances are issued.
